Los Angeles $63 Parking Meter Fine Passes Constitutional Test

A $63 initial fine for overstaying the allotted time at a Los Angeles parking meter isn’t unconstitutionally excessive under the Eighth Amendment, the Ninth Circuit said Wednesday.

The amount isn’t grossly disproportional to the underlying offense of staying too long at a metered space “in one of the most congested cities in the country,” and therefore doesn’t violate the excessive fines clause, the U.S. Court of Appeals for the Ninth Circuit majority said.
